Arvind Kejriwal's assistant suffers a setback in the Swati Maliwal assault case as the Delhi High Court rejects Bibhav Kumar's motion to suppress the arrest.

Chief Minister Arvind Kejriwal's close aide Bibhav Kumar filed a case, which the Delhi High Court denied on Friday. The appeal contested Kumar's detention in connection with an alleged attack at the Chief Minister's house involving AAP MP Swati Maliwal.

Chief Justice Neena Bansal Krishna said, "Petition dismissed."

Bhibav Kumar had requested bail, but the Delhi Police had objected, claiming that granting him one may have an impact on the investigation.

At Kejriwal's official house on May 13, Kumar is accused of assaulting Maliwal. When Maliwal went to visit the CM at his house, Kumar allegedly struck her in the chest, stomach, and pelvic area, according to a FIR.
On May 16, the Indian Penal Code's clauses of criminal intimidation, evidence destruction, assault, and use of force on a lady with the intention of disrobing and attempting to commit culpable murder were the basis for filing a formal complaint against Kumar.


Since his arrest on May 18, Kumar has been held in judicial custody. He filed a petition against his arrest with the Delhi High Court, arguing that it was "illegal" and requesting damages.
Kumar pleaded that his detention was illegal and blatantly against the law, citing Section 41A of the Code of Criminal Procedure (notice of presence before police officer) as the basis for his arrest.

In opposition to the appeal, Delhi Police claimed that Kumar was not detained "in haste" and that his detention was done in accordance with the law.
His bail request is still pending before the Supreme Court after being rejected earlier by a trial court and the high court.

Aam Aadmi Party (AAP) meanwhile denied Rajya Sabha MP Maliwal's claims and charged  accusing her of working with the opposition party.
In the past, there were videos circulating on social media that purportedly showed Maliwal fighting with security guards and leaving the Chief Minister's house on the day of the claimed attack.
